The Los Santos Police Department (LSPD) held a traffic operation between the West Los Santos Area patrol and the Traffic Division on Friday, March 29, 2019. The operation included setting up a check point on Market Street, where drivers were being stopped to ensure "everyone was driving safe", according to an LSPD Sergeant.

Sergeant Navarro of the LSPD spoke to the LS Times and explained that such check points allow officers to spot individuals that are intoxicated and elaborated that such operations will be carried out further across Los Santos. During the operation itself, officers were requesting that drivers show their license before running background checks on them.

Sergeant Navarro was questioned on whether or not officers should be requesting licenses without probable cause to which she reassured that no citizen can be forced to present their driving license. However, when questioned on whether officers were making citizens aware of these rights, the Sergeant admitted that officers did not make them aware and that it had "not been an issue".

In most cases, police officers must have probable cause to suspect a citizen has committed a crime such as a traffic violation in order to request their driver's license. However, in this case officers were not making citizens aware of these rights and therefore, drivers were handing over their license as they felt it was a legal obligation due to how the situation was approached. This could lead to unwarranted background searches or individuals accidentally incriminating themselves. The LSPD has been contacted for further comment and clarification regarding such operations.

Comment: Officers not making people aware of their rights? Sounds very dodgy to me, especially when they use one of the main roads in Los Santos to stop and identify every driver, regardless of any probable cause or actual crime.

According to the Los Santos Penal Code 2018, Title 11, section 0:
5. A peace officer is entitled to an exterior inspection of a vehicle, as well as verification of all paperwork, licenses, registrations, and other documentation during a traffic stop. A full vehicle inspection is permitted with a search warrant or appropriate probable cause.
6. Checkpoints, border controls, and other police operations on public roads must have a documented purpose, documented record of operations, and exist temporarily in response to (or in preparation to) a particular incident, holiday, etc.
7. A peace officer is only entitled to identify the driver of a vehicle when performing a traffic stop or other vehicle checkpoint operation, unless the passenger falls under a reasonable suspicion to be identified, such as matching an APB description.
So yes, citizens should be aware of their rights, as the law enforcement should also be aware of existing law.

Comment: Hi, Fairfield. As a Traffic Officer, I assure you that behind every traffic stop, traffic operation, or any public road police operations, a reason. We do not conduct public road police operations for no reason. For example, we encountered a day where we had a big amount of traffic stops conducted by different Police Officers, which is more than enough a reason for the Los Santos Police Department to conduct a Traffic Operation. Comment: Thank you for your comment, however it is in regards to the legality of such operations. Despite the cause being just, the law refers specifically towards the response or preparation to a particular event. The United States fourth amendment refers to: "the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." This is largely in regards to privacy which is often not respected in this city.

Many individuals, despite wishing to maintain their privacy, are unlawfully pressured into these situations backed by the threat of being prosecuted for failing to identify to a peace officer. However, as a previous comment stated, the best right in this situation is to avoid it completely as many citizens of Los Santos choose to do.
